PLEASE READ THESE TERMS AND CONDITIONS (“TERMS”) CAREFULLY, AS THEY APPLY TO YOUR USE OF the fiction project’S SERVICES (THE “SERVICE”).

The Fiction Project (“Fiction Project,” or “We”, or "Us" or "Organization") offers a free service wherein participants can participate in a conversation, with a person of their choosing, that's sparked by reading fiction.

By using the site, you agree to the following terms of service:

1. PRIVACY

2. OUR PROPRIETARY RIGHTS

The Services and its materials, including, without limitation, text, software, photographs, graphics, images, illustrations, logos, trademarks, patents, copyrights, service marks, photographs, audio, videos and music (“The Fiction Project Content”), and all Intellectual Property Rights related thereto, are the exclusive property of The Fiction Project and its licensors.

Except as explicitly provided herein, nothing in this Agreement shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to distribute, sell, rent, license, distribute, reproduce, copy, publicly display, transmit, publicly perform, adapt, publish, edit or create derivative works from any materials or content accessible on the Service. Use of The Fiction Project Content or materials on the Service for any purpose not expressly permitted by this Agreement is strictly prohibited.

3. ADDITIONAL REPRESENTATIONS AND WARRANTIES

You affirm, represent and warrant, in addition to the other representations and warranties in this Agreement, the following:

(i) You are at least at 18 years of age.

(ii) You have the right, authority and capacity to enter agree to and abide by these Terms.

(iii) If you are under 18 years of age you are either an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, obligations, conditions, affirmations, representations, and warranties in these Terms.

(iv) Your performance of obligations under this Agreement do not and will not violate any other agreement to which you or such entity is a party; and this Agreement constitutes a legal, valid and binding obligation of you.

4. DISCLAIMERS

THE SUBMISSION OF ANY PERSONAL CONTENT THROUGH THE SERVICE AND/OR SITE IS DONE AT YOUR OWN DISCRETION AND RISK. NO REPRESENTATION OR WARRANTY IS MADE THAT THE SERVICES PROVIDE COMPREHENSIVE OR ACCURATE INFORMATION. WE RESERVE THE RIGHT TO FILTER, MODIFY OR REMOVE CONTENT, MEDIA, INFORMATION OR ANY OTHER MATERIAL FROM THE SERVICES AND FROM THE OUTPUT OF THE SERVICES.

5. OWNERSHIP

We request that you never submit an idea or information that you consider to be confidential and/or proprietary. If you choose to submit any ideas, information, blog posts, questionnaires, and any other content , except with respect to information governed by our Privacy Policy, you agree to and hereby grant to us a fully-paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive and fully sublicensable right and license to use, reproduce, perform, display, distribute, create derivative works of, and otherwise commercially or non-commercially exploit in any manner, any and all comments, suggestions, ideas, notes, or other feedback submitted by you the Company.

6. THIRD-PARTY WEBSITES

The Fiction Project may contain links to third-party websites that are not controlled by The Fiction Project.

The Fiction Project has no control over, and assumes no responsibility for, the content, practices, or of any third-party websites or services. If you access a third-party website from The Fiction Project, you do so at your own risk, and you understand that these Terms do not apply to your use of such sites.

You expressly relieve The Fiction Project from any and all liability arising from your use of any third-party website or third-party content.

Additionally, your dealings with or participation in promotions of advertisers found on The Fiction Project site are solely between you and such advertisers. You agree that The Fiction Project shall not be responsible for any loss or damage of any sort relating to your dealings with such advertisers. We encourage you to read the terms and conditions and privacy policy of any third-party websites that you visit.

7. GOVERNING LAW

You agree that:

(i) the Service shall be deemed solely based in California; and

(ii) the Service shall be deemed a passive one that does not give rise to personal jurisdiction over The Fiction Project, either specific or general, in jurisdictions other than California. This Agreement shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles.

8. SEVERABILITY

If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

9. WAIVER

No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and The Fiction Project’s failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.

10. AMENDMENTS

We reserve the right to amend these Terms at any time and without notice. If we do this, we will post the amended Terms on this page and indicate the date the Terms were last revised. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to any of these Terms or any future Terms, please do not continue to use the Service.

11. ENTIRE AGREEMENT
